The U.S. crypto industry could be heading toward a pivotal regulatory moment, with the Securities and Exchange Commission (SEC) potentially moving forward on new digital-asset rules while Congress remains divided over the CLARITY Act. The development could have major implications for token issuers, tokenized securities and assets such as XRP.
Bitwise CIO Matt Hougan argues that SEC action could provide an alternative route toward regulatory clarity while lawmakers continue negotiating legislation. The SEC has scheduled an open meeting for August 14 to consider a proposed “Regulation Crypto” framework.
SEC Could Open a Faster Route for Crypto Rules
The potential SEC proposal would not make the CLARITY Act unnecessary, but it could offer the market a quicker regulatory framework. Under existing authority, the agency could explore exemptions and rules that allow certain crypto projects to raise capital without immediately facing the full burden of securities registration.
Such a framework could also address the transition of projects toward greater decentralization. For the crypto industry, clearer rules could reduce uncertainty that has complicated token launches and investment activity for years.
However, an SEC proposal would only begin the regulatory process. Public comments, revisions and additional approval steps would still be required before any new framework takes effect.
Tokenized Securities Add Another Layer
The SEC could also advance an innovation exemption for tokenized securities. The concept could make it easier to issue and trade digital versions of traditional financial assets on blockchain networks.
If adopted, such rules could support broader blockchain-based financial markets, including the possibility of around-the-clock trading for tokenized equities.
The approach aligns with Chairman Paul Atkins’ Project Crypto agenda, which emphasizes clearer classifications and rulemaking rather than relying mainly on enforcement. Coordination with the Commodity Futures Trading Commission could also help establish clearer boundaries between securities and commodities.
XRP Faces a Separate Catalyst
XRP traders are watching the regulatory developments closely. The token recently slipped below the psychologically important $1 level before quickly recovering, a move analyst Gareth Soloway viewed as a possible short-term bottoming signal.
Soloway has identified the $0.96-$0.97 area as potential support and cited a longer-term wedge breakout as another constructive technical factor. He has also pointed to $1.50-$1.55 as an important resistance zone if XRP gains momentum.
The bigger catalyst could be the CLARITY Act. The legislation has advanced through the House and Senate Banking Committee but remains awaiting further Senate action after the August recess.
SEC rulemaking and congressional legislation could ultimately develop on parallel tracks. SEC action may provide nearer-term clarity, while the CLARITY Act could deliver a more durable statutory framework.
For XRP, passage of CLARITY could improve the regulatory backdrop, although price gains are far from guaranteed. Soloway estimates a potential 50%-100% move under a favorable scenario, but XRP would still need to overcome key technical resistance.

The August 14 SEC meeting could therefore become an important milestone, but the broader regulatory battle is likely to extend well beyond this week.
