Bitpanda Hit With €70,000 MiCA Fine: What Austria’s First Crypto Penalty Means

Austria’s financial regulator has fined crypto platform Bitpanda €70,000 ($82,000) for breaching disclosure and marketing rules under the European Union’s Markets in Crypto-Assets Regulation (MiCA). The case marks the Austrian watchdog’s first publicly announced final penalty under the EU’s new crypto framework, highlighting the growing importance of compliance as MiCA takes effect across the bloc.

Bitpanda Penalized Over White Paper Timing

The Austrian Financial Market Authority (FMA) said Bitpanda failed to submit a required crypto-asset white paper at least 20 working days before it was published.

The regulator also found that the company distributed a marketing communication before the relevant white paper had been released. Under MiCA, crypto firms face specific requirements covering disclosures, communications with investors and the presentation of crypto-asset offerings.

A separate marketing communication was also found to be incomplete. According to the FMA, it did not include required language explaining that the material had not been reviewed or approved by a competent authority and that the crypto-asset provider was responsible for its content.

The communication also lacked a mandatory telephone number and email address.

FMA Decision Is Final

The proceedings were handled through an expedited process, and the €70,000 penalty is now final. The decision provides an early example of how European regulators are applying MiCA’s requirements to established crypto businesses.

MiCA is designed to create a more consistent regulatory framework for crypto assets across the European Union. Its rules cover areas including authorization, investor disclosures, marketing practices and operational obligations.

For crypto platforms, the Bitpanda case shows that regulatory exposure is not limited to major security incidents or customer losses. Administrative and procedural requirements can also result in enforcement action.

Bitpanda Says Customers Were Not Harmed

Bitpanda said the violations were limited to the timing and formal requirements connected with its white paper and an accompanying information document.

The company said customer funds and platform security were unaffected and that customers did not suffer financial losses. Bitpanda also said it corrected the issues after being notified by the FMA and chose to resolve the proceedings quickly and consensually.

The penalty nevertheless sends a broader message to crypto companies operating in Europe: MiCA compliance extends beyond obtaining authorization. Firms must also ensure that disclosures and marketing materials meet detailed regulatory standards before reaching the public.

The Bitpanda penalty could serve as an important compliance warning for other European crypto firms. As regulators become more active under MiCA, companies may face greater scrutiny over documentation, marketing and disclosure procedures.

For investors, the case also underscores why regulated crypto markets depend not only on platform security but on transparent and accurate information.
